Terms of Service
By renting equipment from Cross Country Rentals, you agree to the following terms and conditions outlined in this document. These Terms of Service govern your use of our rental services, and by signing the rental agreement, you acknowledge that you have read, understood, and agreed to these terms.
1. Rental Agreement
- By signing the rental agreement, you acknowledge and agree to all terms and conditions related to the rental of trailers or any other equipment provided by Cross Country Rentals. The rental agreement will specify the duration, rates, and other details specific to your rental.
2. Rental Duration and Charges
-
Rental Period: The rental period is based on the duration specified in the rental agreement (daily, weekly, or monthly). A rental day is considered 24 hours (e.g., 12:00 PM Tuesday to 12:00 PM Wednesday).
-
Late Returns: If the rented trailer or equipment is not returned by the specified end date and time, you will incur an additional charge for each day it is late. The charge will be equivalent to the daily rental rate unless otherwise stated.
-
Rental Rates: Rental charges are subject to change at any time and will be confirmed at the time of booking. Prices are stated in the rental agreement, and you are responsible for payment in full at the time of rental or as otherwise specified.
3. Deposit and Refunds
-
Security Deposit: A security deposit is required at the time of rental. This deposit will be returned after the equipment is returned in the same condition it was rented, minus any fees for damages, late returns, or other costs incurred during the rental.
-
Refunds: The deposit will be refunded, less any deductions for damages, late fees, or other charges, after the equipment is returned and inspected. Refunds typically take 7-10 business days to process.
4. Use of Equipment
-
The rented equipment is to be used only for its intended purpose as specified in the rental agreement. You agree not to use the equipment for any illegal activities or any activities that may cause damage to the equipment or harm to others.
-
Securing Cargo: The renter is solely responsible for securing cargo properly and ensuring compliance with all relevant safety standards, including but not limited to DOT regulations for trailer use.
-
Authorized Operators: Only the person named on the rental agreement is authorized to operate the rented equipment. You may not allow any other individual to use the equipment without prior written consent from Cross Country Rentals.
5. Maintenance and Repairs
-
Renter's Responsibility: You are responsible for basic maintenance during the rental period, including ensuring the equipment is in proper working order (e.g., checking tire pressure, fluid levels, battery, etc.).
-
Damages: You are responsible for any damage to the rented equipment caused by negligence, misuse, or failure to follow proper operating procedures. Any repair costs resulting from such damage will be deducted from the security deposit or added to the total rental cost.
-
Inspection: Upon return of the equipment, Cross Country Rentals will inspect the equipment for damage. If any issues are found, the renter will be charged for repairs or replacement as necessary.
6. Liability
- Renter’s Liability: You are fully responsible for the equipment during the rental period. This includes any damage to the trailer, tire damage, or accidents involving the equipment. You are also responsible for any injury, death, or property damage resulting from the use of the equipment during the rental period.
7. Indemnification
- You agree to indemnify and hold harmless Cross Country Rentals, its employees, agents, and affiliates from any and all claims, damages, losses, liabilities, or expenses, including attorney’s fees, arising from or related to the use of the rented equipment, including claims for property damage, personal injury, or death.
8. Cancellations and Changes
-
Cancellations: You may cancel your reservation by providing notice to Cross Country Rentals in advance. Cancellation fees may apply depending on the timing of the cancellation.
-
Changes to Rental: If you need to modify your rental (e.g., adjusting the rental period), you must inform Cross Country Rentals as soon as possible. Changes are subject to availability and may incur additional fees.
9. Late Fees and Non-Return of Equipment
-
If the rented equipment is not returned on the specified date and time, you will be charged for the additional rental period.
-
If the equipment is not returned or is abandoned, Cross Country Rentals reserves the right to pursue legal action to recover the equipment and any associated costs.
10. Governing Law
- These Terms of Service are governed by and construed in accordance with the laws of the state or region where Cross Country Rentals is based. Any legal disputes arising from these terms shall be resolved in the appropriate jurisdiction.
11. Modifications to Terms of Service
- Cross Country Rentals reserves the right to modify these Terms of Service at any time. Any updates or changes to these terms will be posted on our website or communicated to renters via email or other means. It is your responsibility to review these terms regularly to stay informed about any changes.
